The website, www.Huntvastuhomes.com ("Site") is an electronic web based platform acting in the capacity of, including but not limited to a search engine for Vastu Compliant properties, for exchanging, exploring and enhancing business online for Vastu Compliant real estate, housing and properties in India. HuntVastuHomes is a proprietorship, having its Registered office at D-85, 203, Above Lalji Advocates, D-Block, Sector 63, Noida, Hazratpur Wajidpur, Uttar Pradesh-201301.


These terms of use ("Terms") constitute a legally binding agreement between you and HuntVastuHomes   (the "Company/ We/ HuntVastuHomes or Us") regarding the use of the web application/ website www.Huntvastuhomes.com (the "Site") or the domain thereof and any service offered or deemed to be offered by the Company including but not limited to delivery of content regarding Vastu Compliant homes via the Site, any mobile or internet connected device or otherwise (the "the Service").


Your use of the Site and services and tools are governed by the following Terms & Conditions which are incorporated herein. By mere use of the Site, you shall be contracting with HuntVastuHomes ____Limited, the owner of the Platform. These terms and conditions including the policies constitute your binding obligations, with HuntVastuHomes. Therefore, it is imperative that before using the platform you acquaint yourself and understand the applicability and consequential application of these terms & conditions.


When You use any of the services provided by Us through the Platform, including but not limited to, (e.g. Vastu Compliant rating of any Unit/Flat, availability of Vastu Compliant Properties), You will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into these Terms and shall be considered as part and parcel of these Terms.

HuntVastuHomes may amend/modify these terms and conditions at any time, and such modifications shall be effective immediately upon posting of the modified terms and conditions on HuntVastuHomes. You may review the modified terms and conditions periodically to be aware of such modifications and your continued access or use of HuntVastuHomes, shall be deemed conclusive proof of your acceptance of these terms and conditions, as amended/modified from time to time. HuntVastuHomes reserves the right to suspend the operations for support or technical upgradation, maintenance work, in order to update the content or for any other reason without intimating any user in advance.

 

DEFINITION CLAUSE
Unless otherwise specified, the capitalized words shall have the meanings as defined herein below:

  1. "Agreement" shall mean and include the present terms and conditions stated herein and shall also include amended/modified terms and conditions from time to time. 
  2. "Company"/ “HVH”/HuntVastuHomes”: is defined as HuntVastuHomes ("the Company") a Proprietorship, having its Registered office at D-85, 203, Above Lalji Advocates, D-Block, Sector 63, Noida, Hazratpur Wajidpur, Uttar Pradesh-201301, along with its unit for the Company's website Huntvastuhomes.com.
  3. "My Subscriptions" contains time to time information and description of the Services for the User provided by the Company in writing or contained in the website Huntvastuhomes.com.
  4. Paid Services: Access to the Site and certain features are provided to all Users free of charge. However, the Site reserves the right, without prior notice, to restrict access to certain areas or features of the Site ("Paid Services") to paying Users or Users who undergo a specific registration process. 
  5. “Registration Data" is the database of all the particulars and information supplied by the User on initial application and subscription, including but without limiting to the User's name, telephone number, mailing address, account and email address.
  6. "Real Estate Professionals," or "REPs" are users who have created accounts (free or paid) with us to avail our advertising services, and avail our other Services that we direct towards the professional real estate community. REPs include landlords, agents, developers, institutional property consultants, mortgage professionals and other service providers .
  7. “RERDA” shall mean and include the Real Estate (Regulation and Development) Act, 2016 as amended read with any rules or regulations that might be framed thereunder. By using the Site and its Services, the Real Estate Professionals represent and warrant that (a) All registration information submitted is truthful and accurate; (b) The Real Estate Professionals will maintain the accuracy of such information; (c) The use of the Site does not violate any applicable law or regulation. (e) Real Estate Professional’s profile may be deleted and his Membership may be terminated without warning, if we believe that Real Estate Professionals is in breach of any of the above terms. (f) In no event the Site or Company   i.e. HuntVastuHomes will be liable for any damages including, without limitation, indirect or consequential damages, or any damages whatsoever arising from use or loss of use, data, accuracy of Vastu compliant Rating, or profits, whether in action of contract, negligence or other tortuous action, arising out of or in connection with the use of the site.
  8. "User" will include everyone who is a Subscriber/REP’s and Browser/Visitor(s) either as an individual or corporate subscriber for availing the Services as provided by HuntVastuHomes. "User" or "You" also includes any person who access or avail the Services provided by the Company for the purpose of hosting, publishing, sharing, listing, transacting, viewing, displaying or uploading information or views for Vastu Compliant homes and includes other persons jointly participating in using the Services provided by the Company.
  9. Un-Authorized User: - Any person who does not have a legal or a contractual right to access the services, but does so, will fall within the definition of an 'Unauthorized User' and will be subject to the terms and conditions, and expressly so with respect to the intellectual property rights of the Service provider, and abiding by licensing terms and conditions.
  10. “Vastu Expert” would mean the Vastu expert of HuntVastuHomes viz. Dr. Smita Jain Narang, who has a wide Knowledge and experience in the field of Vastu Shastra. Dr. Narang has been awarded with PhD Degree in Vastu Shastra and is managing a Vastu Shastra consultancy/education firm, nationally and internationally. 
  11. "www.Huntvastuhomes.com" is defined as the internet website or mobile application of the Company on the internet.

That the Users agree to use this site only for lawful purposes, and in a manner which does not infringe the rights of, or restrict or inhibit the use and enjoyment of this site by any third party. Such restriction or inhibition includes, without limitation, conduct which is unlawful, or which may harass or cause distress or inconvenience to any person and the transmission of obscene or offensive content or disruption of normal flow of dialogue within this site. If any User/individual; /entity become aware of any inappropriate content by any User of this site, or otherwise please contact us by clicking on the "Contact" link at the footer of every page.


That the HVH shall not be liable for any such information or data which is not within its knowledge / acknowledgment / contraventions / copyright issues committed by its Users and which is beyond the control of verification.


Users agree to accept communications (through Calls/Chat/ Mails/SMS/Whatsapp) on the numbers made available during registration or subsequently, via registration forms, posting requirements, feedbacks or any such form that has provision for phone number / mobile number; with respect to the subscribed services of Huntvastuhomes.com.

 

TERM
These Terms shall continue to form a valid and binding contract between the Parties and shall continue to be in full force and effect till the User continues to access the Site and avails the Services provided by the Company.

SERVICES
Company provides a number of internet-based services through its platform and shall include:

  1. Finding Vastu Compliant Homes in various projects through the methodology developed by HuntVastuHomes in the nearby area of the user where he/she may intends to find a Unit/Flat.
  2. Assisting the user by engaging in discussion to find their Vastu Compliant Unit/Flat as per their specified requirements.
  3. Connecting the User to the Builder for the property shortlisted by the User.
  4. Helping the user from shortlisting of any Unit/Flat till the Final Purchase of the Unit and assisting the user throughout the process of Document verification and execution.

Certain Services provided by HuntVastuHomes are subject to payment of subscription fees and can be purchased through various methods of payments offered. The purchase of Services shall be governed by specific policies of sale, like subscription fees, payment and Refund clause, Cancellation clause mentioned in the present terms and conditions.

 

ELIGIBILITY
You hereby represent and warrant to the Company that you are at least eighteen (18) years of age or above and are competent to enter into a valid and binding contract apart from being capable of entering, performing and adhering to these Terms & Conditions. While individuals under the age of 18 may utilize the Service of the site, they shall do so only with the involvement & guidance of their parents and / or legal guardians, under such Parent /Legal guardian's registered account. You agree to register prior to uploading any content and / or comment and any other use or services of this site and provide your details including but not limited to complete name, age, email address, residential address, and contact number.

USER'S OBLIGATIONS

  1. The User agrees and expressly states that he/she is solely responsible for the accuracy and completeness of the Registration Data and other information given to the Company in the application for Membership in order to use the Services provided by the company. The User will ensure that the data shared with Huntvastuhomes.com doesn't contain any fraudulent, false, misleading or manipulated facts.
  2. In case a User is covered under the RERDA, it shall ensure all necessary compliance necessary, including but not limited to obtaining the necessary registrations etc.
  3. The User is responsible for the set-up or configuration of all the necessary equipment required to access the Service.
  4. The User will comply with all notices or instructions given by the Company from time to time in respect of the use of the Service.
  5. The User shall be solely responsible for all information retrieved, stored and transmitted through the Service by him.
  6. The User is solely responsible for the maintenance of confidentiality of the login information.
  7. This would include the User's password and Username and all activities and transmission performed by the User at Huntvastuhomes.com.
  8. The User will immediately notify the Company of any unauthorized use of the User's account or any other breach of security known to the User.
  9. The User will pay promptly the Subscription Fees as required by the Company from time to time.
  10. The User will take all such measures as may be necessary (including without limitation changing his password from time to time) to protect the secrecy.
  11. In case you chose to discontinue your association with us, you can unsubscribe / remove your account by deactivating your profile from the Platform of HuntVastuHomes.

PAYMENT AND REFUND CLAUSE

  1. For purchase of subscriptions provided by HuntVastuHomes, the amount quoted on the website will be the Final amount and once a payment is made against any Subscription the same shall be non-refundable.
  2. At the time of making the payment against any Subscription, in case any discrepancy arises on the payment platform/payment gateway, the company shall not be liable for the same.
  3. In case the payment has not been paid to the Company against the subscription sought to be availed by the User, the Company shall not be liable to provide such services to the User.
  4. In case payment is made by the User to avail any of the paid services offered by the Company and after the payment of the Subscription Charges, the User chooses not to avail the services provided by HuntVastuHomes   , the Company shall not be held liable for any Refund.
  5. In case of difference of opinion of any third party Vastu-Expert on the Vastu Compliant Unit/Flat provided on the Platform of the Company, the Company shall not be held liable for any Refund.  
  6. In case the User purchases any Subscription from the Platform of the Company, the same shall be utilized by the User within 48 days of the Payment, failing which the subscription shall lapse. 

CANCELLATION

  1. Company reserves the exclusive right to cancel/ stop any content whatsoever from being published or reflected on its website or in any other mode. 
  2. The Company reserves its Right to cancel the subscription of any user at its sole discretion, for which no cancellation or refund shall be payable by the Company.

SECURITY

  1. Transactions on the Site are secure and protected. Any information entered by the User when transacting on the Site is encrypted to protect the User against unintentional disclosure to third parties. The User's credit and debit card information is not received, stored by or retained by the Company / Site in any manner. This information is supplied by the User directly to the relevant payment gateway which is authorized to handle the information provided, and is compliant with the regulations and requirements of various banks and institutions and payment franchisees that it is associated with.
  2. To protect the secrecy of user identification and/or password the User shall take all such measures as may be necessary (including but without limiting to changing his/her password from time to time and shall not reveal the same to any other person(s).
  3. Since a user identification is necessary to access the Service; the User shall use only his/her own user identification.
  4. The User shall not use any software to automatically download or/and extract either a complete or/and partial listing from Huntvastuhomes.com database without prior consent from Huntvastuhomes in writing.
  5. Huntvastuhomes shall in no way be directly, indirectly or remotely liable for any fraudulent transaction or deduction of money from the bank account of any User.

USE OF DATA SUPPLIED
The User hereby agrees and irrevocably authorizes that the Company has the right to:

  1. Use for the Company's own purpose, any data or/and information supplied by the User in connection with this Agreement, and/or pass on such information to any other associated companies or selected third parties. The Data of the User gathered by the Company may also be shared with the Real Estate Developer.
  2. Retain all data or/and information supplied by the User while using the Service to remain at Huntvastuhomes.com for the exclusive use of the Company in accordance with service agreement with the User, notwithstanding any termination of the Agreement or suspension of the Service to the User herein. Anything contrary to the above, unless specifically put down in writing, following the termination or suspension of the Service to the User, all such data and information shall remain in the Company's property, records and databases as the exclusive property of the Company, for all times to come.
  3. By entering Mobile Number on Hunvastuhomes.com while registering for an account for receiving alerts, contacting a property, seller/buyer, user gives expressly consent to the Company and its Partners/ Vendors and sub-partner, sub vendor to send alerts, contact details promotional SMS and Promotional Calls to the mobile number entered by the user. In case user does not want to receive these messages on his/her mobile number, and not agreed any of the terms stipulated herein, he/she shall not submit his/her mobile number with Hunvastuhomes.com.

CONFIDENTIALITY

  1. For the purpose of this Agreement and attachments thereto and all renewals, "Confidential Information" means any Information that is received by the User from the Company’s Platform after the payment of the Subscription charges. The Information provided by the Company to the User on the Payment of Subscription Charges, shall be confidential and the User herein is under an Obligation to not share/disseminate such information to any third party.
  2. All information and data submitted by the User shall become the property of the Company. However, all such information shall be kept strictly confidential and the Company shall not, subject to "Violation of Terms & Conditions" clause, release any such data and information to any third party without the prior consent of the User.
  3. The User has access to only his/its own data and information stored in the database of Huntvastuhomes.com (subject to prior confirmation of identity) and nothing more. The User may edit or amend such data and information from time to time.
  4. All confidential information (including name, e-mail address etc.) voluntarily revealed by the User in chat and bulletin board areas, is done at the sole discretion and risk of the User. If such information, collected by a third party is misused or results in unsolicited messages from such third parties, then such actions are beyond the use beyond the control and liability of Company and the company accepts no responsibility or liability whatsoever for such actions.

INTELLECTUAL PROPERTY  

  1. All logos, brands, trade marks and Service marks ("Marks") of HuntVastuHomes appearing on its website solely belong to HuntVastuHomes. Whereas, any logos, brands, trademark and service marks of the Real Estate Professional, listed on the website of the HunVastuHomes is the sole property of Real Estate Professional and HuntVastuHomes respects the Intellectual Property Rights of all, it has and will continue to adhere to all the laws applicable in India. HuntVastuHomes shall protect and respect the Intellectual Property of the User and the Third Party to the best of its ability. All rights accruing from the same, statutory or otherwise, shall wholly vest with HuntVastuHomes and its associates. The access to HuntVastuHomes does not confer upon the User any license or right to use in respect of these Marks and therefore the use of these Marks in any form or manner, whatsoever is strictly prohibited. Any violation of the above would constitute an offence under the prevailing laws of India.
  2. HuntVastuHomes respects the Intellectual Property Rights of all, it has and will continue to adhere to all the laws applicable in India in this respect. HuntVastuHomes shall protect and respect the Intellectual Property Rights of the users as well as third parties to the best of its ability. In a case where a User(s) are found to be using HuntVastuHomes as a platform to infringe the Intellectual Property Rights of others, HuntVastuHomes will be free to terminate this Agreement forthwith without any notice to the user.
  3. By allowing Users to access HuntVastuHomes, grants the Users a limited, non-exclusive, non-assignable, revocable license (the "License") to access and use the Services, provided that the User is in compliance with the terms and conditions of the Agreement.
  4. Unless expressly agreed to in writing, nothing contained herein shall give the User a right to use any of the Site's trade names, trademarks, service marks, logos, domain names, information, questions, answers, solutions, reports and other distinctive brand features, save according to the provisions of these Terms. All logos, trademarks, brand names, service marks, domain names, including material, designs, and graphics created by and developed by the Site and other distinctive brand features of the Site are the property of the Company  . Furthermore, with respect to the Site created by the Company, the Company shall be the exclusive owner of all the designs, graphics and the like, related to the Site.

VIOLATION OF TERMS AND CONDITION
In the event of violation of the above Terms and Conditions, the Company in its sole discretion may pursue any of its legal remedies, including but not limited to the immediate deletion of any offending material from its site, or/and cancellation of your account, and/or the exclusion of any person(s) who may have violated any Terms & Conditions hereto and seeking any injunctive relief from any court of competent jurisdiction. Company can also pursue violators with claims that they have violated various criminal and/or civil law provisions as applicable under the relevant Acts/Rules, etc. of the land. Hunvastuhomes.com will cooperate with any investigation by any Central or/and State or/and local body or/and any court or/and tribunal having the competence to carry out the same. Such cooperation may be without notice to the User. If Company believes in its sole discretion that any advertisement or/and services may create liability for Company, Company may take any actions that it believes to be prudent or necessary to minimize or/and eliminate its potential liability, including but not limited to, the release of User information. In sum, Company reserves the right to refuse service to anyone at any time, or/and to remove any listings or/and any advertisements for any reason, and without notice.

ENTIRE AGREEMENT
This Agreement shall constitute the complete and exclusive agreement between the parties with respect to the subject matter hereof, superseding any prior agreements, documents and or communications regarding such subject matter. This Agreement may only be modified, or/and any rights under it waived, by a written document executed by the Company only. The right to change vary or amend, however exclusively rests with the Company.

GOVERNING LAW AND JURISDICTION

  1. It is clarified that there is no agency or/and partnership or/and joint venture or/and employee-employer or/and franchiser-franchisee relationship between Company and any User of the Service.
  2. The User agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms & Conditions must be filed within 30 days after such claim or cause of action arose or be forever barred.
  3. All information of whatsoever nature received from the user is in good faith and is bona fide. The information is believed to be true/ correct and complies with the laws of the land.
  4. This Agreement and any dispute or matter arising from incidental use of Huntvastuhomes.com is governed by the laws of India and the User and Huntvastuhomes.com hereby submit to the exclusive jurisdiction of the courts at Noida, Uttar Pradesh, India. 

ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS AND CONDITIONS
The terms and conditions appearing herein above consists of the entire agreement between the Party/User (as defined above ) and the Company (as defined above ) and replaces all previous arrangements/schedules between the parties regarding the subject matter contained herein above. By completing the registration process and/or checking the "I have read and accept the Terms of Use" box, the User is indicating his/her acceptance to the agreement and to be bound by all of the terms and conditions of the Company as appearing hereinabove.
